Local Law No.6 (Waste Management) 2018, Adopted by Council

At its General Meeting, held 17 January 2018, North Burnett Regional Council resolved to make Local Law No.6 (Waste Management) 2018, with the purpose and general effect of this local law being to protect the public health, safety and amenity related to waste management within the North Burnett region.

There was no existing local law when this resolution was passed nor any model local law, interim local law and or subordinate local law relating to waste management in place. The Local Law has identified anti-competitive provisions; viz. section 5, 6(1), 7(1) and (2), 8(1) and (2), 9(1) and (2), 11, 12(1), and 13.

Within the recommendation, it was resolved that each anti-competitive provision identified in the Public Interest Plan be retained in the overall public interest as the benefit of the anti-competitive provisions to the community as a whole outweighs the cost, and the most appropriate way of achieving the objectives of Local Law No.6 (Waste Management) 2018 is by restricting competition in the way provided in the anti-competitive provisions.
